H.B. 439 to exempt fire alarm systems from home improvement requirements

Annapolis, MD. — Joe Hoellerer, an SIA manager of government relations, testified before the Maryland Senate Finance Committee on March 30 in support of an amendment to protect fire alarm companies from unnecessary regulation.

Under proposed legislation H.B. 439, Maryland residents would receive an extended period of time to rescind signed contracts for home improvements.

Originally, the bill included alarm systems under the definition of home improvements, but Hoellerer successfully argued this would be detrimental to fire and life safety on behalf of the Security Industry Association (SIA) and alarm companies. Md. Del. Benjamin Kramer, D-Montgomery County and chief-sponsor of H.B. 439, introduced an amendment to his bill which would exempt fire alarm systems.

Prior to the amendment, Hoellerer explained SIA’s concerns in a written statement.
“Due to the incorporation of fire alarms under the ‘home improvement’ definition, this legislation would—we believe contrary to its overall intent—subject alarm companies to the requirements, causing a number of uncertainties within our industry and interrupting a traditional business model that has proved beneficial for consumers,”

Hoellerer said. “First, alarm companies typically offer products and services in a bundle. Our member companies commonly offer intrusion detection, fire and smoke notification, and carbon monoxide monitoring systems as one bundled package. H.B. 439 may make it necessary for alarm companies to isolate the fire alarm component of their products and services, and adopt several different types of contracts for the state. SIA has found that a majority of alarm companies each utilize one consistent contract format that is used nationwide.” SIA will continue to track this legislation and other states legislative activity on behalf of its members.
